By purchasing through this website you agree to be bound by the terms and conditions laid out below.
These terms and conditions apply to online transactions only and do not apply to any purchases made in store.
These conditions do not affect your staturtory rights as a consumer
Definitions
"buyer" means the consumer who buys or agrees to buy goods on this website from Newland Bedding Centre LTD
"goods" means all products listed on the order and the order confirmation e-mail
"consumer" has the meaning given in section 12 unfair Contract Terms Act 1977
"special items" Means any goods that are not held in stock by Newland Bedding Centre LTD and are ordered and/or manufactured specifically for the buyer
"delivery" means the delivery of the goods to the delivery address specified on the order.
Limitations of Liability
Our total liability in regard to the performance of this contract shall be limited to the value of the goods.
Newland Bedding Centre LTD shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compenstion arising out of the performance/or non performance of this contract.
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law.
All contracts shall be governed by English Law.
Any order placed by the buyer and accepted by Newland Bedding Centre LTD is subject to the following terms and conditions unless specified in writting by a Director of Newland Bedding Centre LTD.
A confirmation of your order will be sent automatically by e-mail and, unless you are notified to the contray within 48 hours of this confirmation, the order will be deemed to be accepted by Newland Bedding Centre LTD.
Newland Bedding Centre LTD retains the right to refuse any order that is subject to a pricing error or typing error on its website and will in these circumstances reimburse the buyer in full.
Description of goods
The description of the goods will be as specified within the confirmation e-mail and it is the buyers responsibility to check that the goods specified are as the buyer intended to order.
All sizes are approximate and the buyer should satisfy them selfs that the goods will fit into the address. The normal sizes (i.e 3' single, 4'6 double and 5' king) refer to the sleeping surface, If in any doubt the buyer should check the overall dimensions.
There may be certain items included in the illusration of a product which are not part of the product and are not included in the product description and are not part of the order (for example headboards, bedside tables, lamps and bed covers).
Pictures are for illusration purposses only and although we try to be as accurate as we can, we are subject to manufactures changes.
Payment
Full payement is required at the time the order is placed and Newland Bedding Centre LTD will collect the payment from the debit/credit card details supplied.
All prices on this site are in U.K Pounds and include any VAT payable at the prevailling rate.
Delivery
Once confirmation of the order has been sent to the buyer Newland Bedding Centre LTD will contact the buyer and arrange delivery of the goods, If the goods are in stock delivery will be aimed to be within 7 days of the order. If the goods need to be orderd Newland Bedding Centre will give you an estimated delivery day, however this is only an estimate and time shall not be the essence of any order.
If when Newland Bedding Centre LTD contact the buyer to arrange delivery and the buyer is not ready for the goods Newland Bedding Centre LTD will store the goods free of charge. It is then the buyers responsibility to contact Newland Bedding Centre LTD to arrange delivery.
Where the goods cannot be delivered on the day arranged due to the fault of the buyer (for example goods will not fit in address, or nobody present at time of delivery) Newland Bedding Centre retains the right to charge a furthur £25 for "re-delivery" to cover costs incurred. This charge will be taken from the debit/credit card used to purchase the goods.
If Newland Bedding Centre LTD has failed to deliver the goods within 30 days of the order date due to it's own neglect ( on either stock or special items) then the buyer may cancel the contract without penalty.
Delivery is officially to the front door only. Newland Bedding Centre LTD or the delivery driver do not accept any responsibility for any damages that may occure, It is the buyers responsibility to remove any hazzords.
Goods must be checked and signed for on delivery of goods, any damages to goods must be reported on delivery as Newland Bedding Centre LTD will not be responsible for any reported damages at a later date.
Most goods will require some form of assembly. It is the buyers responsibility to assemble the goods.
Delivery will be deemed to have taken place when the goods have been delivered to the agreed address (Newland Bedding Centre LTD do not need to satisfy themselves that the person accepting delivery at the agreed address is authorised by the buyer to accept the goods).
Gurantees
All goods are guaranteed against faulty materials and workmanship for a minimum period of twelve months from the date of delivery.
Faulty Goods
Complaints relating to faulty goods should be notified via e-mail or telephone or in writing within 7 days of the fault becoming apparent.
In the rare event that goods develop a fault Newland BeddingCentre LTD retains the right to have the goods repaired or replaced at Newland Bedding Centre Ltd discretion, any delivery costs associated with the exchange of faulty goods will be met by Newland Bedding Centre LTD
Where goods are reported as faulty later than 7 days after delivery Newland Bedding Centre LTD reserve the right to arrange an independent inspection, if the goods are found on inspection to not be faulty but a result of fair wear and tear, negligence or wilful damage, Newland Bedding Centre Ltd retain the right to charge £25 for the inspection to cover costs. This charge will be taken from the debit/credit card used to purchase the goods. The buyer and Newland Bedding Centre LTD shall both agree to be bound by the results/findings of the independant inspector.
Refunds
Refunds on goods cancelled prior to delivery will be made as soon as possible after notification and will be subject to a £25 administration charge. All refunds will be made onto the same card used to make original purchase.
Refunds on goods already delivered will take place as soon as possible following the collection/return and inspection of such goods.
No refund shall be made until the goods have been collected/returned and inspection made as to their condition
Cancellation
The buyer may cancel the goods at any time prior to delivery of the goods, Newland Bedding Centre retains the right to charge a £25 administration charge on cancelled orders.
Due to the intimate nature of beds and mattresses these items are excempt from the statutory 7 day cooling off period under the Distance Selling Regulations when they have been unsealed. Therefore for reasons of health and hygiene any beds or mattresses that have been unsealed will be deemed to be used and cannot be retured for any reason other than a manufacturing fault.
